Effective date: October 15, 2026
Last updated: October 15, 2026
Version: 1.0
About this Agreement. This User Agreement describes the specific rules, responsibilities, and conduct expected of individual users of GCOS. It complements our Terms of Service (which governs the overall contractual relationship) and Privacy Policy (which governs data handling). In case of conflict, the Terms of Service prevail.
1. Agreement to Terms
By creating an account or using any part of the GCOS Services, you ("User", "you", "your") enter into this User Agreement with GCOS ("we", "us", "our"), operator of the platform at https://thegcos.com/.
This Agreement incorporates by reference our Terms of Service and Privacy Policy. You must read and accept all three documents before using the Services. If you are using the Services on behalf of an organization, you confirm you have authority to bind that organization.
2. Account Creation and Security
2.1 Registration
To use the Services, you must register for an account by providing accurate, current, and complete information. You must be at least 18 years old (or the age of majority in your jurisdiction).
2.2 One Account
Each individual or organization may hold only one Free account. Creating multiple accounts to circumvent trial limits, pricing, or restrictions is prohibited and may result in suspension of all associated accounts without notice.
2.3 Credentials
You are responsible for maintaining the confidentiality of your login credentials. Do not share your password or allow others to access your account. Use strong, unique passwords and enable multi-factor authentication where available.
2.4 Account Activity
You are solely responsible for all activity occurring under your account. Notify us immediately at security@thegcos.com if you suspect unauthorised access or any security breach.
2.5 Team Accounts
Paid Subscriptions include multiple user seats (3 for Starter, 10 for Growth, unlimited for Enterprise). The primary account holder is responsible for managing team members, including inviting, removing, and ensuring their compliance with this Agreement.
3. Acceptable Use Policy
You agree to use the Services only for lawful business purposes consistent with the following principles:
-
Use the Services in good faith to classify legitimate commercial goods;
-
Provide accurate product information and descriptions;
-
Review and verify classifications before submission to CBP or other authorities;
-
Respect the intellectual property, privacy, and legal rights of others;
-
Comply with all applicable laws, including customs, trade, data protection, and export control regulations;
-
Report bugs, security issues, or classification errors responsibly through official channels;
-
Treat GCOS staff and other users with respect in all communications.
4. Prohibited Conduct
The following activities are strictly prohibited. Violations may result in immediate account suspension or termination, forfeiture of fees paid, and potential legal action.
You must NOT:
-
Submit false, misleading, or fraudulent product information intended to evade customs duties, taxes, restrictions, or sanctions;
-
Use the Services to classify or facilitate shipment of goods prohibited by law (weapons, controlled substances, counterfeits, sanctioned items, CITES-restricted species, etc.);
-
Reverse engineer, decompile, disassemble, extract source code, or derive the AI models underlying the Services;
-
Scrape, crawl, or systematically extract data from the Services using automated tools without written authorization;
-
Resell, redistribute, white-label, or sublicense the Services or their outputs without a signed partnership agreement with GCOS;
-
Use the Services to build, train, or improve a competing product;
-
Create multiple accounts (personally or via other persons) to circumvent trial limits, pricing, or any restrictions imposed by GCOS;
-
Use fake or temporary email addresses to register;
-
Introduce malware, viruses, worms, or any malicious code into the Services;
-
Attempt to gain unauthorized access to any part of the Services, other users' accounts, or related systems;
-
Impersonate another person, entity, or GCOS staff;
-
Interfere with, degrade, or disrupt the Services or servers (e.g., denial-of-service attacks, excessive automated queries beyond fair use);
-
Use the Services in violation of any applicable law, regulation, or third-party agreement;
-
Harass, abuse, threaten, or intimidate GCOS staff, other users, or any third party.
GCOS reserves the right to investigate suspected violations, cooperate with law enforcement, and take any action we deem appropriate, including reporting to authorities.
5. Customer Content and Data
5.1 Ownership
You retain all rights, title, and interest in the Customer Data you submit to the Services, including product catalogs, descriptions, shipment records, and uploaded documents.
5.2 Responsibility for Content
You are solely responsible for the accuracy, legality, and appropriateness of all Customer Data you submit. You represent and warrant that:
-
You have the legal right to submit the Customer Data;
-
The Customer Data does not infringe any third-party intellectual property, privacy, or other rights;
-
The Customer Data does not contain personal data of third parties except as necessary and lawfully processed;
-
The Customer Data does not contain unlawful, harmful, or prohibited content.
5.3 License to GCOS
By submitting Customer Data, you grant GCOS a worldwide, non-exclusive, royalty-free license to use, process, store, reproduce, modify, and display the Customer Data as necessary to: (a) provide the Services; (b) comply with legal obligations; and (c) improve our AI classification models (subject to opt-out as described in our Privacy Policy).
5.4 Data Export
You may export your Customer Data at any time via account settings or API. Upon account termination, you have 30 days to export data; thereafter, data may be deleted per our retention schedule.
6. License Grants
6.1 License to User
Subject to compliance with this Agreement, our Terms of Service, and timely payment of any fees, GCOS grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your internal business purposes during the term of your Subscription or Free account.
6.2 Restrictions
You may not: (a) copy, modify, or create derivative works of the Services; (b) rent, lease, lend, or sublicense the Services; (c) use the Services for the benefit of a third party in a service-bureau capacity (except as permitted for partners under a separate agreement); or (d) remove or alter any copyright, trademark, or proprietary notices.
6.3 Beta Features
GCOS may offer beta or experimental features marked as such. These are provided "AS IS" without warranty and may be modified or discontinued at any time without notice. Beta features may not be subject to standard SLAs.
7. Classification Accuracy and User Responsibility
Important. GCOS provides HTS classifications and compliance recommendations based on artificial intelligence models trained on CBP rulings and precedents. However:
-
Classifications are informational, not legal advice;
-
Users are solely responsible for the accuracy of customs declarations and filings;
-
CBP retains ultimate authority on HTS determinations;
-
For high-stakes classifications (large duty amounts, new product categories, restricted items, Section 232/301 concerns), GCOS strongly recommends review by a licensed customs broker or trade attorney;
-
GCOS is not a licensed customs broker and does not file entries on your behalf.
You acknowledge that GCOS shall not be liable for duties, penalties, delays, or other losses arising from classifications you accept and submit to CBP without appropriate human review. Confidence scores and low-confidence flags are provided to assist your review process.
8. Service Availability and Modifications
8.1 Availability
GCOS strives to maintain high availability as described in the Terms of Service. Scheduled maintenance will be announced in advance where practicable. Unscheduled downtime may occur due to events outside our reasonable control.
8.2 Service Modifications
We may add, modify, or remove features at any time. For material changes affecting paid Subscriptions, we shall provide reasonable advance notice.
8.3 Discontinuation
If we discontinue a Service or feature, affected Users shall be notified at least 60 days in advance where feasible, with options to export data and (for paid Subscribers) receive prorated refunds for unused portions of prepaid terms.
9. Reporting Violations
If you become aware of any violation of this Agreement, suspected security vulnerability, or illegal activity involving the Services, please report it promptly:
-
Security vulnerabilities: security@thegcos.com
-
Abuse or policy violations: abuse@thegcos.com
-
Copyright infringement: legal@thegcos.com (please include details sufficient to identify the content and your authority)
We follow responsible disclosure practices and shall not take legal action against good-faith security researchers who follow our disclosure policy.
10. Suspension and Termination
10.1 Suspension by GCOS
We may suspend your access to the Services, with or without notice, if we reasonably believe that: (a) you have violated this Agreement, our Terms of Service, or applicable law; (b) your use poses a security, legal, or operational risk; (c) your account is engaged in fraudulent or abusive activity; or (d) you have not paid fees when due.
10.2 Termination for Cause
Material or repeated violations may result in permanent termination of your account without refund of any paid fees.
10.3 Termination by User
You may terminate your account at any time via account settings or by contacting support@thegcos.com. For paid Subscriptions, cancellation takes effect at the end of the current billing cycle unless otherwise specified in an order form.
10.4 Effect of Termination
Upon termination, your right to access the Services ends. You have 30 days to export Customer Data; thereafter, data will be deleted or anonymized within 90 days, except as required by legal retention obligations.
11. Communications
11.1 Transactional Communications
By creating an account, you consent to receive essential service communications, including account notices, billing alerts, security notifications, policy changes, and Launch Trial cliff reminders. These cannot be opted out of while the account remains active.
11.2 Marketing Communications
With your consent (or as permitted by applicable law), we may send marketing communications about features, offers, tips, and industry updates. You may opt out at any time via the unsubscribe link in each message or via account settings.
11.3 Preferred Channels
Primary communication is via the email address associated with your account. Ensure your email address is current and that GCOS emails are not filtered as spam.
12. Export Control and Sanctions
The Services may be subject to export control, sanctions, and trade compliance laws of multiple jurisdictions, including those of the United States, the United Kingdom, the European Union, and other applicable regimes. You represent and warrant that:
-
You are not located in, under the control of, or a national or resident of any country or territory subject to comprehensive sanctions administered by the United Nations, U.S. OFAC, EU, UK, or any other competent authority;
-
You are not identified on any restricted-party or sanctioned-party list (including Specially Designated Nationals, Entity List, Denied Persons List, or equivalent);
-
You shall not use the Services to export, re-export, transfer, or otherwise provide goods, data, or technology in violation of applicable export control or sanctions laws;
-
You shall not use the Services to facilitate transactions with sanctioned parties, in sanctioned jurisdictions, or for prohibited end-uses.
GCOS reserves the right to refuse service or terminate accounts to comply with sanctions and export control laws.
13. Changes to this Agreement
We may modify this User Agreement from time to time. For material changes, we shall provide at least 30 days' notice via email or in-app notification. Continued use of the Services after the effective date constitutes acceptance of the updated Agreement. If you do not agree to the changes, you must stop using the Services and may terminate your account.
